MISSOULA, Mont., Feb. 14 (UPI) -- Former Montana quarterback Jordan Johnson was told in no uncertain terms to halt his sexual advances, the woman Johnson allegedly raped last year testified.
The woman told the jury in Johnson's rape trial Wednesday she and Johnson were kissing on her bed at the time but she made it clear she was not planning on sleeping with him.
"I gave him very clear instructions," the woman testified. "I told him, 'No, not tonight.' I resisted with my arms, resisted with my knees ... I told him no."
The cozy evening degenerated into an alleged sexual assault, prosecutors alleged. The woman said while she struggled physically, she was in a state of shock and failed to call out to her roommate for help.
The Missoulan in Missoula, Montana, said state law does not require the victim to physically resist for sex to be considered non-consensual. The jury must only determine the victim had refused to go through with the act and that the perpetrator was aware of that refusal.
The trial continued Thursday.
