DAYTONA BEACH, Fla., Dec. 13 (UPI) -- Officers were correct in not charging the NASCAR president after a witness reported him driving at a "reckless speed," Florida officials said.
The Daytona Beach police did not give NASCAR President Brian France special treatment, the State Attorney's Office said in a letter.
A store clerk had called 911 after spotting a Lexus racing down several city streets, the Daytona Beach News-Journal reported.
Clerk Shirley Hill followed France to the guard shack of his condo while she told police how the man was driving on curbs, struck a parked car and then scraped a tree.
Hill had no idea she was pursuing France until a condo security guard told her, the newspaper said.
When questioned, France told officers he was drinking a soft drink while driving and "bumped into something," the initial report states. Police saw evidence of a spilled soft drink inside his car.
France, 44, was not cited and not given a field sobriety test. Police said he did not smell of alcohol, Chief Mike Chitwood said.
