ORLANDO, Fla., Sept. 10 (UPI) -- A Florida appeals court has scheduled a hearing next month in the case of former astronaut Lisa Nowak accused of attempting to kidnap a romantic rival.
The 5th District Court of Appeal will hear arguments Oct. 21 on whether to let stand a circuit judge's order to toss out Nowak's statements to police and evidence found in her car, the Orlando Sentinel reported Wednesday.
Orange County Circuit Judge March Lubet ruled an Orlando police detective failed to adequately advise Nowak of her constitutional rights after her arrest.
He also ruled police failed to properly obtain permission to search her vehicle which was parked at a motel near Orlando International Airport.
Nowak gained national attention in February 2007 when she drove from Houston to Orlando and attacked Air Force Capt. Colleen Shipman who she believed was a competitor for the affections of an unmarried fellow astronaut.
