Mich. loses delay on affirmative action

LANSING, Mich., Dec. 30 (UPI) -- A federal appeals court has ruled that Michigan must immediately implement a state constitutional amendment that bans admissions based on race and gender.

In a decision handed down late Friday, the three-judge panel overturned a U.S. district judge's six-month delay for the University of Michigan, Wayne State and Michigan State University, the Detroit News reported.

"Proposal 2 is reborn," said Terry Pell, president of the Center for Individual Rights. "The people voted on this, and elected officials of Michigan have to carry out the will of the people without running to the nearest federal court."

The amendment, which passed in November with 58 percent of the vote, set Dec. 23 as the day it was to take effect. The three universities, backed by Gov. Jennifer Granholm, asked for a delay, arguing that it would be unfair to change admissions standards in the middle of the application season.
