NEW YORK, July 21 (UPI) -- The Manhattan district attorney in New York has declined to bring charges against actor Kiefer Sutherland for an altercation last May, officials say.

The "24" star, who is on probation for a prior drunken driving conviction, was accused of head-butting fashion designer Jack McCollough outside a nightclub after the two exchanged words. Sutherland subsequently apologized for his behavior and McCullough accepted the mea culpa.

TMZ reported Tuesday the Manhattan district attorney's office has decided not to prosecute Sutherland because it considers the incident a petty matter.

The entertainment news Web site said the Los Angeles city attorney also has no plans to charge Sutherland with a probation violation because of the altercation.
