Scott Peterson preliminary hearing delayed

MODESTO, Calif., Oct. 17 (UPI) -- A California judge Friday granted a defense motion to delay the start of Scott Peterson's preliminary hearing until Oct. 28.

A Stanislaus County judge agreed to the request made by lawyer Mark Geragos, who has another trial under way in Los Angeles.

Peterson is charged with two counts of murder in the deaths of his wife, Laci, and her unborn child last winter.

The defense Thursday sought to supress wiretap evidence on the grounds police failed to note in their request for the taps that a cadaver dog found no sign of Laci in her husband's fishing boat. Peterson allegedly used the boat to dump the body in San Francisco Bay.

The case is under a gag order, but the Modesto Bee said Friday that legal experts concluded the dog's failure to pick up Laci's scent didn't necessarily mean she was never in the boat.
