Daily News sued in Harry Potter book flap

NEW YORK, June 18 (UPI) -- A federal suit was filed Wednesday against the New York Daily News, seeking damages for unauthorized publication of excerpts from the new Harry Potter book.

The new book's American publisher, Scholastic Inc., and author J.K. Rowling charged the newspaper with unauthorized publication of excerpts, both on-line and in print. The book -- "Harry Potter and the Order of the Phoenix" -- is to be released at 12:01 a.m. Saturday.

The civil suit, filed in New York's U.S. District Court, seeks damages in the tens of millions of dollars for various claims, including copyright infringement.

In a public statement, Scholastic said it and Rowling want all readers, "especially children," to have the opportunity to experience the new book at the same time.

Scholastic added, "We intend to strongly enforce the terms of our on-sale agreements with retailers and distributors."
