Lesser charge added to Muschany trial

JEFFERSON CITY, Mo., March 4 (UPI) -- Prosecutors say they will allow jurors to consider a lesser count in the sexual assault trial of a former Missouri state lawmaker.

The St. Louis Post-Dispatch said Wednesday that prosecutors had filed an alternative misdemeanor count of sexual misconduct against former state Rep. Scott Muschany in addition to the previous felony charge of deviate sexual assault.

Muschany faces trial later this month for an alleged assault on the 14-year-old daughter of a state employee with whom he was having an affair last year.

The newspaper said the new allegation charged Muschany, 42, exposed himself to the Jefferson City girl "under circumstances in which he knew that such conduct was likely to cause affront or alarm."

Muschany resigned last year.
