Wis. judge vacates 1985 homicide verdict

MILWAUKEE, Jan. 30 (UPI) -- A Wisconsin man convicted of homicide in 1985 was released from prison Friday partly because of new DNA evidence, officials said.

Robert Lee Stinson, 44, who was convicted of first-degree intentional homicide in 1985, was ordered released on $25,000 signature bond by Milwaukee County Judge Patricia McMahon, the Milwaukee Journal Sentinel reported.

Stinson had been convicted based in part on testimony that he bit the victim, but four forensic odontologists found that the bite marks on the victim were not Stinson's.

Additionally, DNA from a man found on the victim's sweater did not match Stinson's DNA.

"We are thrilled that the truth has finally come out," said Byron Lichstein, Stinson's attorney for the Wisconsin Innocence Project. Evidence of Stinson's innocence "has always driven our devotion to the case. He has waited a long time for this day."

In a statement, Milwaukee County District Attorney John Chisholm said his office agreed Stinson should receive a new trial.

Deputy District Attorney Kent Lovern said his office was assessing the evidence in the case and would decide whether to prosecute Stinson before a scheduled court hearing July 27.
