Florida city's saggy-pants law challenged

RIVIERA BEACH, Fla., Sept. 16 (UPI) -- A Florida public defender is calling for the voiding of ordnance banning "saggy pants" worn by fashion-conscious teenagers.

Carol Bickerstaff says the statute approved in March by Riviera Beach, Fla., voters is unconstitutional and will be appealed by her office.

Bickerstaff represented Julius Hart, 17, who spent a night in jail after he was stopped by police while riding his bicycle with, allegedly, 4-5 inches of his boxer shorts exposed.

The Palm Beach (Fla.) Post said Wednesday that the citation amounted to a violation of Hart's probation resulting from a marijuana possession charge.

"Your Honor, we now have the fashion police," Bickerstaff said at Monday's hearing.

The judge agreed, the newspaper said, and ordered Hart released pending a hearing on the matter in October.
