New trial ordered for Judith Clark

NEW YORK, Sept. 26 (UPI) -- A New York federal judge has ordered a new trial for a 1960s revolutionary convicted of killing two police officers and a guard in 1981.

U.S. District Judge Shira Scheindlin said Judith Clark's constitutional rights were violated by not having an attorney represent her in court, despite the fact that she had agreed to represent herself in the trial, the White Plains (N.Y.) Journal News reported Tuesday. Scheindlin ruled the new trial must begin within 90 days.

Prosecutors said they plan to appeal the ruling.

Clark was convicted killing Nyack, N.Y., police Sgt. Edward O'Grady and Officer Waverly "Chipper" Brown and Brinks armed car guard Peter Paige during the 1981 robbery. Clark, David Gilbert and Kawasi Balagoon, aka Donald Weems, were convicted of three counts of second-degree murder, six counts of

first-degree robbery and several counts of assault and larceny.

The convicted parties were members of revolutionary groups Weather Underground and Black Liberation Army, the New York Daily News reported.
