Accused bomber seeks evidence exclusion

BIRMINGHAM, Ala., Sept. 21 (UPI) -- Lawyers for a man suspected of four bombings in the southern United States say there was insufficient cause to arrest him, CNN reported Tuesday.

Eric Rudolph, being held without bail in Birmingham, Ala., is accused of bombing an abortion clinic in that city in 1998, and three other bombings in Atlanta, including the one that killed a woman during the 1996 Summer Olympics.

His lawyers said in court Monday police had no reason to arrest him when he was found hiding amid milk crates behind a store in North Carolina in May 2003.

The defense argued there was no probable cause to believe Rudolph was committing a crime nor that he was a fugitive, and therefore he should not have been detained.

It wants any evidence gathered during that period suppressed. His attorneys also filed motions in federal court arguing the death penalty was unconstitutional and should not be an option in his trial.

Jury selection for Rudolph's trial is scheduled to begin in March.
