Dec. 19 (UPI) -- Katie Holmes spent her 40th birthday with rumored boyfriend Jamie Foxx.
People confirmed the actress enjoyed dessert with Foxx and her mom, Kathleen Stothers-Holmes, in New York on her birthday Tuesday.
Holmes and Foxx were spotted arriving at Serendipity 3 restaurant. Holmes wore a t-shirt and jeans with a colorful cardigan, while Foxx sported a plaid coat.
Us Weekly said Holmes ordered a strawberry sundae, while Foxx and Stothers-Holmes had frozen hot chocolate. Stothers-Holmes was spotted leaving the restaurant with a cake box.
"Katie and Jamie looked happy. They both came in the same car together, with her mom," an insider said. "[They] all seemed like they were having a great time."
Holmes and Foxx have been linked for years, but have yet to publicly confirm their relationship. The pair were all smiles during a date this month in New Orleans, where Holmes is filming an adaptation of The Secret.
"They still plan to keep their relationship private," a source told E! News in April. "This is what has worked for them and what they are comfortable with."
Holmes was previously married to Tom Cruise and is parent to a 12-year-old daughter, Suri Cruise, with the actor.
