During the hearing, Assistant Prosecutor Thomas Weidt said that DiGirolamo told friends he could no longer afford to keep Amy Giordano and their son in an apartment in Hightstown, N.J. DiGirolamo lived several miles away with his wife.

One friend, John Russo Jr., led investigators to a pond on Staten Island in New York where they found a suitcase and human bones. Weidt said traces of blood were also discovered in the Hightstown apartment.

Police have been searching for Giordano since her son was found in a Delaware hospital parking lot last year. DiGirolamo received a probationary sentence there for abandoning the boy.

DiGirolamo's lawyer said there is no direct evidence against his client.

"Absolutely nothing, not a single word uttered by the prosecutor is evidence," Jerome Ballarotto said. "It's all talk."
