Alleged shooter of former Saints player claims self defense

NEW ORLEANS, April 12 (UPI) -- The suspect in the killing of former New Orleans Saints star Will Smith said he feared for his life as the confrontation escalated and was not the aggressor, the man's lawyer said.

Cardell A. Hayes, 28, who is being held on $1 million bond on suspicion of second-degree murder, pleaded not guilty in his hearing. His lawyer, John Fuller, told NBC News he would have to leave the case due to his impending judgeship and a potential conflict of interest.

Police said Hayes' Humvee rear-ended Smith's Mercedes-Benz on Saturday night, then he shot the athlete twice.

Fuller told a different story of the shooting, which he said began with another driver hitting Hayes' car and then speeding off.

Fuller said other people at the scene feared for their lives as well.

"We talked to a number of witnesses who were out there also who were fearful based on the actions of parties besides Mr. Hayes," Fuller said, noting "ballistics will support what I'm telling you."
