Plain White T's unseats Rihanna at No. 1

NEW YORK, July 19 (UPI) -- Plain White T's steadily climbing "Hey There Delilah" moved to the top of the Billboard Hot 100 chart of U.S. singles sales, displacing Rihanna's "Umbrella."

"Umbrella" moved to No. 2 from the top spot, which it called home for seven consecutive weeks.

Fergie's "Big Girls Don't Cry" remained at No. 3 for a second week, while Shop Boyz' "Party Like a Rockstar" held on at No. 4.

Timbaland's "The Way I Are" featuring Keri Hilson moved up one to No. 5 from No. 6, while T-Pain's "Buy U a Drank (Shawty Snappin')" featuring Yung Joc fell to No. 6 from No. 5.

Hurricane Chris' "A Bay Bay" edged up one to No. 7. T-Pain's "Bartender" moved up from No. 10 to No. 8.

Former chart-topper "Makes Me Wonder" by Maroon 5 was No. 9, down from No. 7, and "Makes Me Better" by Fabolous featuring Ne-Yo was No. 10, up from No. 11.

Potter shipments raises Scholastics' ire

NEW YORK, July 19 (UPI) -- Scholastic, the U.S. publisher for the Harry Potter series, said it is legal action against two companies for shipping the finale ahead of its Saturday debut.

The New York publisher said it learned that some people received "Harry Potter and the Deathly Hallows" through the mail, the result of a breach of the agreement between the distributor Levy Home Entertainment and the shipments made by DeepDiscount.com, one of Levy Home's customers, Scholastic said in a news release.

"We are taking immediate legal action against DeepDiscount.com and Levy Home Entertainment," Scholastic said. "The number of copies shipped is around 1-100th of 1percent of the total U.S. copies to go on sale at 12:01 am on July 21st."

The publisher also directly appealed to Harry Potter fans who received the books early by asking that "they keep the packages hidden until midnight on July 21st."

The exact cause of the breach remains unclear, The Washington Post reported Thursday.

"We're knee-deep in an internal investigation, and we're taking the matter extraordinarily seriously," Andrew Moscrip, a spokesman for DeepDiscount.com, told the Post.


Daniel Baldwin says 9th time the charm

LOS ANGELES, July 19 (UPI) -- Daniel Baldwin, part of the U.S. Baldwin acting family, says it's a daily struggle but he thinks this time he's got a good shot at staying away from cocaine.

Baldwin told CNN talk show host Larry King Wednesday he's using the 12-step method, including going to regular group meetings, to help him cope with his addiction, which he says he developed within six months of first using cocaine in 1989.

"Every second of every day," he said, he's moving either toward continued sobriety or toward relapse, but so far he's stayed clean.

Baldwin, 46, has gone through nine stints in rehabilitation but thinks this time it'll stick because if he didn't quit, "I was going to die."

Another motivation: He wants to be there for his son. Baldwin also said his family was slow to believe he's truly turned the corner but have begun to rally around him as he re-earns their trust.


Primetime Emmys announced

NORTH HOLLYWOOD, Calif., July 19 (UPI) -- Newcomers "Heroes," "Ugly Betty" and "30 Rock" joined longtime favorites as contenders Thursday when primetime Emmys were announced in North Hollywood, Calif.

Absent from the top categories for programming, however, were "Desperate Housewives" in the outstanding comedy category and spy thriller "24" as top drama.

Cable channel HBO collected the most nominations overall with 86. Its presentation of Dee Brown's "Bury My Heart at Wounded Knee," which chronicles how American Indians were displaced as the United States expanded west, led all shows with 17 nods.

"The Sopranos," which ended its run on HBO this season, pulled in 15 nominations.

Nominated for outstanding comedy series are "The Office," "Entourage," "30 Rock," "Two and a Half Men" and "Ugly Betty."

For outstanding drama, the nominees are "Boston Legal," "Grey's Anatomy," "Heroes," "House" and "The Sopranos."

Fox will televise the 59th Primetime Emmy Awards Sept. 16 from Los Angeles.
