'Dr. Phil' diet plan lawsuit settled

LOS ANGELES, Sept. 26 (UPI) -- A $10.5 million settlement has ended a false advertising lawsuit in Los Angeles over weight loss products endorsed by TV therapist "Dr. Phil" McGraw.

McGraw will not be liable for any of the settlement money in the suit that charged him with making false claims about Shape Up weight loss products made by CSA Nutraceuticals of Irving, Texas, the Los Angeles Times reported Tuesday.

Under the settlement, anyone who bought Shape Up products can either accept $12.50 for every box they bought, up to four boxes, or take two Nutrilite Daily Multivitamin/Multimineral supplements for each Shape Up purchase, attorney Henry Rossbacher said.

CSA Nutraceuticals stopped making Shape Up products in 2004 amid a false advertising investigation by the Federal Trade Commission.

An estimated 100,000 people seeking to shed weight took McGraw's advice and followed the Shape Up plan that included taking 22 pills a day at a cost of $120 a month, the Times said.
