Lawsuit challenges Medicare drug plan

PHILADELPHIA, Dec. 6 (UPI) -- A lawsuit has been filed in Pennsylvania asking a court to block automatic enrollment of "dual eligibles" into managed care plans.

The Pennsylvania Health Law Project and Philadelphia Community Legal Services have asked a judge to certify the suit as a class-action, the Pittsburgh Post-Gazette reported. About 100,000 Pennsylvanians are "dual eligibles," who qualify for both Medicaid and Medicare.

The Medicare Prescription Drug Benefit law has created a lot of confusion and sparked several legal challenges. A similar lawsuit was filed last month in New York.

In Pennsylvania, most dual eligibles get prescriptions through Medicaid while relying on Medicare for most of their healthcare.
