Insurers sue in dispute over Paxil

MINNEAPOLIS, May 12 (UPI) -- Blue Cross and Blue Shield of Minnesota and 18 other insurers have sued the drug maker GlaxoSmithKline in a generic dispute over Paxil.

The suit alleges the federal patent system was manipulated to keep cheaper generic alternatives to the popular antidepressant off the market.

GlaxoSmithKline was accused of violating federal and state antitrust laws and fraud laws and engaging in deceptive trade practices, the Minneapolis Star-Tribune said Thursday.

The lawsuit alleges that the drug company claimed to hold patents on scientific procedures that already were in the public domain and listed invalid patents with the U.S. Food and Drug Administration that kept other pharmaceutical manufacturers from making generic equivalents.

Nancy Pekarek, a spokeswoman for GlaxoSmithKline, said the company had not seen the lawsuit and would have no comment.
