Prosecutors puzzled over woman who says husband told her to shoot him

GREENFIELD, Ind., Oct. 1 (UPI) -- Indiana prosecutors say they are trying to determine whether, and with what, to charge a woman who says she killed her husband because he told her to shoot him.

Elizabeth Roberts has told investigators her husband, Gary Roberts, gave her the instruction after he learned police were going to arrest him because of the weapons and explosives he kept in the house, the Indianapolis Star reported Monday.

Gary Roberts, 57, allegedly told his wife Friday he was not going to jail and would kill any officers who came to their home in Greenfield. Elizabeth Roberts, 56, said she told her husband she would shoot him, if necessary, to stop him.

He handed her the gun, she said, and told her to shoot him. She did, hitting him once in the chest.

Hancock County Prosecutor Michael Griffin said his office was considering several alternative charges.

"Obviously, an intentional killing is murder, but there are justifications in the law that would make it other things," he said.

He said other options included voluntary manslaughter and even self -defense.

"We're evaluating whether she was defending herself or defending law enforcement," Griffin said.

Griffin's office filed a motion Monday to detain the woman another 72 hours, giving prosecutors until Wednesday to decide what, if any, charges to file.
