Man sues after NYC subway attack

NEW YORK, April 30 (UPI) -- A retired postal worker who was attacked by a chainsaw-wielding man in the New York City subway is suing following the incident.

Michael Steinberg suffered a punctured lung among other injuries in 2006 when a man police said was on drugs grabbed two saws off a work station left unattended by contractors performing work on the Manhattan station.

The New York Daily News said Steinberg wept as his lawyer recounted the events to jurors in Manhattan Supreme Court Monday.

Steinberg is suing Five Star Electrical Corp., for allegedly leaving the saws unattended and available for someone to grab in the 3 a.m. incident. The suit also names the attacker, Tareyton Williams, who was convicted and sentenced to 18 years in prison. Williams is not expected to appear at the trial.

Barbara Sheehan, Five Star's attorney, said there was no reason workers should have expected someone to grab the saws and attack a subway passenger.

She argued the company wasn't negligent because they had no reason to believe someone "would do something so over the top, so beyond the pale, so criminal."
