NEW YORK, June 21 (UPI) -- A New York teenager blinded in one eye during a fight at his Brooklyn middle school intends to sue the city for $16 million, his father said.
Kardin Ulysse, 14, says school employees failed to protect him from two other students who punched him repeatedly in the face this month during an attack in the cafeteria at Roy H. Mann Junior High School.
"They were beating him, kicking him, punching him in the face many, many times," the boy's father, Pierre Ulysse, said Tuesday at a news conference. "There is no guarantee he will see again."
The family has filed a notice of claim to protect their right to seek damages from the Department of Education.
The eighth-grader has had two eye operations and needs a transplant, Pierre Ulysse said.
The claim alleges staff members did nothing to stop or prevent the assault on the eighth-grader and "failed to obtain proper emergency medical treatment," WNYC-TV, New York, reported.
The father said his son has been beaten and bullied at school on other occasions.
Marge Feinberg, a spokeswoman for the Education Department, said police arrested the two seventh-graders accused of attacking Kardin. The incident is under investigation, she said.
