NYC cop said to admit rape in recording

NEW YORK, Feb. 20 (UPI) -- A New York policeman charged with raping a woman later admitted it to her when she secretly taped him, a former prosecutor says.

Kenneth Moreno, 43, is accused of raping the very drunk victim in her East Village apartment on Dec. 7, 2008, as his partner Franklin Mata, 28, sat in the next room. They go on trial on charges of rape, burglary and official misconduct this week.

The victim called the Manhattan district attorney and was wearing a wire when she confronted Moreno in front of his police station a few days after the crime, the ex-prosecutor, who was not identified, told The New York Post.

"He tries to deny they had sex, but eventually he admits to it," said the source. "He says, 'It wasn't done intentionally. I didn't mean to hurt you. I just got caught up. I'm sorry.' "

She told him she recalled awaking on her bathroom floor, then being in bed as he stripped her clothes. He responded, "It turned from us trying to help you to getting really crazy."

Moreno then apologizes and says, "If you stop drinking, I'll be your boyfriend."

The defense is expected to say the sex was consensual, the report said.
