DNA does not match lacrosse players

DURHAM, N.C., Feb. 28 (UPI) -- A court motion filed in the Durham, N.C., case says genetic samples taken from an alleged sexual assault victim do not match the accused Duke lacrosse players.

The motion, filed Tuesday, says 12 of 22 genetic samples taken from the accuser contain male DNA that does not match any of the three players indicted for the alleged crime, the Durham Herald-Sun reported Wednesday.

The DNA sample suggests that four men were involved in the alleged assault but none of the samples indicate the accused parties or any other Duke lacrosse players were involved in the incident.

The revelation followed earlier claims from defense attorneys that the prosecution was withholding the DNA evidence because of its potential benefit to the defendants, ABC News reported.

The papers were also filed one day before District Attorney Mike Nifong faces the North Carolina State Bar to defend his handling of the case. Nifong, who has recused himself from the case, faces accusations of keeping evidence from the defense and lying to the court and bar investigators.
