New trial denied for Martha Stewart

NEW YORK, July 8 (UPI) -- A New York judge Thursday refused to grant TV celebrity Martha Stewart a new trial, paving the way for her sentencing next week for conspiracy.

Stewart also will be sentenced for obstructing justice, WestportNow.Com reported.

In the ruling, U.S. District Judge Miriam Goldman Cedarbaum also affirmed the conviction of Stewart's former Merrill Lynch & Co. broker, Peter Bacanovic.

The judge rejected a claim alleged perjury by a government witness deprived the two of a fair trial. That claim came after a U.S. Secret Service laboratory director was indicted for perjuring himself during Stewart's first trial.

Stewart was found guilty March 5 of conspiring with her former stockbroker to hide the reason behind her sale of shares in the biotech company ImClone Systems Inc. on Dec. 27, 2001.

She was convicted of one count of conspiracy, two counts of making false statements and one count of obstruction of agency proceedings. Legal experts say she could get a prison term ranging from 10 months to two years.
