SUSSEX, England, Dec. 3 (UPI) -- A British prison guard is fighting to get his job back after being fired for making an insensitive remark about terror leader Osama bin Laden.

While working two months after the Sept. 11 attacks on the United States, Colin Rose, 53, was told he had to go because, although he did not know it, three Muslim visitors could have heard the comment he made about the terrorist.

The firing stemmed from a Nov. 15, 2001, incident. Rose threw a set of keys down a metal chute at the prison gatehouse. Someone commented it sounded like the keys were going to go through the tray at the bottom. Rose responded with: "There's a photo of Osama bin Laden there."

Rose was first given a reprimand but then was fired six months later, the London Telegraph reported.

Rose, a former Coldstream Guardsman with a 21-year unblemished record in the prison service, is claiming unfair dismissal.

During the incident another prison officer told him to be quiet because two Asian women wearing headscarves and an Asian man were at the window of the gatehouse.

The investigation never discovered whether the visitors heard the comment.

Rose's appeal is continuing.
