CLEVELAND, Sept. 17 (UPI) -- Cleveland prosecutors say they won't file charges against actor Matthew Fox over his alleged altercation with the driver of a party bus.

Fox had been accused of assaulting Heather Bormann in August when she refused to allow him to board the vehicle she was driving for a private party.

Fox was in Cleveland at the time filming "Alex Cross" and will apparently not have to come back to answer any criminal charges.

"After a review of the facts, (officials) came to the conclusion not to charge," a representative for the local Cleveland prosecutor's office told TMZ.

But People said Saturday the incident is not yet over. Bormann has filed a lawsuit accusing the actor of hitting her repeatedly, causing physical injuries and emotional distress.
