Spears' open sexuality ends libel suit

LOS ANGELES, Nov. 7 (UPI) -- A Los Angeles judge has dismissed a libel suit filed by pop singer Britney Spears due to the singer's openness regarding her sexuality during her career.

TMZ.com reported that Los Angeles Superior Court Judge Lisa Hart Cole Monday threw out the suit, which Spears had brought against Us Weekly over a rumored sex tape the singer made. The judge found that the singer had "put her modern sexuality squarely, and profitably, before the public eye."

Cole said that by publicly exposing her sexuality through various music videos and reality TV series, there was little chance the article would prove to be defamatory to Spears.

The suit had arisen from an Us Weekly report that the singer and her husband, Kevin Federline, were concerned that a sex tape they had made together would find its way into the public forum, said the Web site.
