Suit against Newton-John thrown out

LOS ANGELES -- Attorneys for Olivia Newton-John announced Monday that a federal judge has dismissed a lawsuit against the singer over her bankrupt chain of Koala Blue stores.

U.S. District Judge Lourdes Baird granted a request Friday by Newton- John and business partner Pat Farrar for a summary judgment, finding there was insufficient evidence to support claims of breach of contract and unfair competition.

Attorney Marshall B. Grossman said the suit, which sought millions in damages for Koala Blue franchise holders in Minneapolis and Chicago, was set to go to trial in December.

Newton-John and Farrar, who sang together in Australia, opened the first Koala Blue stores in 1983, selling casual clothing and accessories mainly from their home country. At one time there were more than 60 stores worldwide.

The recession drove the chain into Chapter 11 bankruptcy protection in 1991. In early 1992, the business was liquidated.

Newton-John, known for pop hits like 'I Honestly Love You' and 'Physical,' currently is promoting her new book, 'A Pig Tale.'
