Woman appeals pizza bomber conviction

ERIE, Pa., Dec. 18 (UPI) -- A Pennsylvania woman convicted of strapping a bomb to a pizza deliveryman and forcing him to rob a bank said she is taking her case to the U.S. Supreme Court.

Marjorie Diehl-Armstrong saw her latest appeal rejected by the U.S. 3rd Circuit Court of Appeals Nov. 15, the Erie (Pa.) Times-News said Monday. She was convicted in November 2010 in federal court in Erie for kidnapping the man, Brian Wells, in 2003 and forcing him to rob the bank in Summit Township, Pa. The bomb later went off, killing Wells.

Diehl-Armstrong, 63, was sentenced to life in prison plus 30 years but has maintained her innocence.

"I just hope the appeal gets through," she said in a telephone call from prison. "I am innocent."

She maintains the bipolar disorder she's been diagnosed with made her unfit for trial.

Her first hurdle will be getting justices to hear the case. The Supreme Court only hears oral arguments on a fraction of the requests it gets each term. No timetable was set for when the court would determine if her case would be heard, the newspaper said.
