Florida judge considers self-defense case

MIAMI, Nov. 29 (UPI) -- A judge is considering whether Florida's Stand Your Ground law applies in the case of a woman charged with killing the man suspected of killing her husband.

Assistant state attorney Ansley Peacock argued Wednesday that Janepsy Carballo of North Miami acted as "the judge, jury and executioner for revenge or whatever other justification she thought she had" when she shot Ilam Nissim five times in the back in May 2008, The Miami Herald reported.

The shooting took place a month after Carballo said Nissim killed her husband and wounded her young son. Carballo, who testified in her own behalf this week, contends Nissim entered her house uninvited and she feared him.

However, authorities allege she bragged to an informant wearing a police wire about having killed Ilam.

Judge Beth Bloom said she would take a few weeks to decide whether the state Stand Your Ground self-defense statute applies.

If immunity is not granted, Carballo's case will go to trial before a jury, the newspaper said.
