Dismissal sought in Casey Anthony damage suit

ORLANDO, Fla., Sept. 14 (UPI) -- A motion to dismiss has been filed in a Florida court against a lawsuit seeking more than $15,000 in damages from Casey Anthony.

Master scuba diver David Badali charges in the suit he risked his life searching alligator-infested waters for Anthony's 2-year-old daughter Caylee when she knew her child wasn't there, the Orlando (Fla.) Sentinel reported Wednesday.

Badali's search was conducted in a stretch of the Econlocahatchee River that runs through a park where Anthony had said Caylee was kidnapped.

Badali filed the suit after Anthony's defense attorney said in court Anthony knew her child had drowned in the family swimming pool.

Charles Greene, Anthony's civil attorney, has asked Judge John Marshall Kest to dismiss Badali's lawsuit.

"If this lawsuit were allowed to proceed, it would open the floodgates to similar claims by other members of the public," Greene said.

He argued a growing number of people are filing lawsuits against Casey Anthony to obtain publicity and otherwise attempt to profit from her ordeal.

Anthony was acquitted this summer in the death of her daughter.
