CHICAGO, Dec. 10 (UPI) -- A Chicago woman is suing McDonald's because an employee allegedly spit in her face over a breakfast bagel with bacon, court records indicate.

Sara Thienes said she pulled into the Chicago McDonald's about 4 a.m. one morning last December to order a cheeseburger, the Chicago Tribune reported.

In the lawsuit filed in Cook County Circuit Court, Thienes said an employee told her in "an aggressive and unfriendly" tone that only items from the breakfast menu were available.

Thienes said she then asked for a bagel with ham, only to have the server tell her that bagels can't be ordered with ham, just bacon.

Thienes said she ordered the bagel with bacon, and pulled forward to pick up her order. She said the employee screamed at her, stuck her head out of the drive-in window, and spit in her face.

Thienes filed a police report the following day, claiming she suffered injury, embarrassment and humiliation. She is suing for unspecified monetary damages.

"As always, we investigate claims to gather the facts and take action as appropriate," said Ron Lofton, who operates the McDonald's franchise. "At this time, these are just allegations."
