Fetus's DNA leads to rape charge

UPPER DARBY, Pa., June 2 (UPI) -- A Philadelphia-area man has been charged with sexually assaulting his girlfriend's sister after he was determined to be the man who made her pregnant.

Upper Darby Police Superintendent Michael Chitwood said the 19-year-old victim did not report the rape when it happened, so investigators had no evidence from a rape kit, the Philadelphia Daily News reported. Samuel Nyenka, 26, was arrested last week after DNA from the victim's aborted fetus was matched to his.

The alleged victim said Nyenka raped her as she slept in the home he shared with her sister, Chitwood said. She decided to go to police after realizing she was pregnant.

"She was concerned it would destroy any relationship she had with her sister, who seemed to be in love with this guy, and she wondered who would believe her," Chitwood said.

The alleged victim had already had an abortion. Police, with her permission, got a search warrant to get the fetus's DNA.

Nyenka denied having sex with the 19-year-old, either consensual or rape, Chitwood said.
