A medical examiner has ruled the death of Daniel Kerrigan, 70, a homicide caused by the struggle with his son coupled with pre-existing heart conditions, the Globe said.

Authorities placed a number of conditions on Kerrigan's release, including that he wear a GPS locating device linked with a machine to monitor for the presence of alcohol in his system.

Mark Kerrigan returned to Stoneham where his mother Brenda lives.

"The Kerrigan family is delighted to have Mark back with them," the family said in a statement. "They ask that you respect their privacy as they welcome Mark home."

Kerrigan was arrested at the Stoneham home Jan. 24 and charged with assault and battery after the fatal altercation with his father.

The 45-year-old has a history of mental-health problems and alcohol abuse, according to court records.
