Pharmaceutical official must reveal assets

CINCINNATI, April 25 (UPI) -- Harriet Warshak of Berkeley Premium Nutraceuticals, which makes the drug Enzyte, must reveal all her assets or face jail time, a U.S. District judge says.

U.S. District Judge S. Arthur Spiegel said he was "disappointed" Warshak, who was convicted on fraud and money laundering charges last year, failed to report a $100,000 certificate of deposit to federal prosecutors, The Cincinnati Enquirer said Friday.

"Most alarming is the fact that defendant 'forgot' about a $100,000.00 certificate of deposit," Spiegel wrote in a court order. "The court is disappointed with both defendant's counsel and defendant."

Warshak, whose son Steve founded Berkeley Premium, insists she forget about the deposit funds despite asset records showing she used $10,000 of the funds to pay personal bills.

Spiegel said Warshak, 75, has 60 days to disclose all of her assets to avoid immediate jail time. The Enquirer said the U.S. District judge is allowing Warshak to remain free while appealing her two-year prison sentence from her 2008 conviction.

Steve Warshak was sentenced last August to 25 years in prison after he and other Berkeley employees were convicted of victimizing thousands of their customers by misrepresenting their products.

Enzyte is an herbal supplement purported to help with penis size.
