SAGINAW, Mich., March 10 (UPI) -- A Michigan man paying $500 support for a child he did not want has sued claiming that he has a right to avoid procreation.
Matthew Dubay of Saginaw says his girlfriend told him that she was incapable of having children and that she was using birth control as a backup, the Chicago Tribune reported. But she became pregnant and refused to have an abortion.
Dubay's suit has the backing of men's rights groups which argue that men should have the same right to decide whether to be fathers that Roe vs. Wade gave women. But legal experts do not believe the suit filed Thursday is likely to succeed.
Charles Kindregan Jr. of Suffolk University Law School in Boston, who called the suit "a lost cause," told the Tribune that the only way to enforce that right would be to force women to have abortions, which the Roe decision bars.
"There is a consistent and strong policy in this country that when a child is born, both parents are responsible, whatever the sins and deceptions of either parent," said Marcia Greenberger of the National Women's Law Center.
