Judge rejects new Stewart trial

NEW YORK, May 5 (UPI) -- A federal judge in New York Wednesday refused to grant Martha Stewart a new trial on charges of lying about her stock purchase.

The judge said Stewart had failed to show how a juror allegedly lying on a jury questionnaire about his prior arrest affected the trial.

Domestic diva and media mogul Stewart and her stockbroker Peter Bacanovic were convicted in March of lying about the sale of ImClone Inc. stock. The government argued Stewart had received an insider tip in December 2001 on the pending refusal by the Food and Drug Administration to approve an ImClone cancer drug. Stewart claimed she had a standing order to sell when the price fell to a certain level. She was not charged with insider trading.

The juror who allegedly lied about his arrest told the media after the trial that the conviction was a "victory for the little guy," CNN said.

Stewart and Bocanovic are scheduled to be sentence in June. Stewart could face up to five years in prison, but is expected to get much less.

Both Stewart and Bacanovic have appealed.
