Pez sues museum over giant dispenser

SAN JOSE, Calif., July 1 (UPI) -- The company that makes Pez candy is suing a California museum, seeking to have a giant Pez dispenser created by the owners destroyed.

Pez Candy Inc. said in the federal lawsuit, filed in San Jose, Calif., that the giant snowman Pez dispenser at the Museum of Pez Memorabilia in Burlingame amounts to trademark infringement and should be destroyed, KTVU-TV, Oakland, Calif., reported Wednesday.

Gary Doss and his wife Nancy, who own the museum and created the giant dispenser with the snowman head, said they are puzzled by the lawsuit.

"I don't know if you need to be authorized to make a work of art and that's what this is. It's one piece. It's not for sale; I'm not selling it to anybody," Gary Doss said. "We're not making thousands more."

A lawyer representing Pez, which previously forced the Dosses to change the name of their museum, refused to comment, KTVU-TV said.
