Trash dumping case thrown out

BLACKBURN, England, Nov. 10 (UPI) -- Magistrates in Blackburn, England, have thrown out a case against a man accused of dumping rubbish after his wheelie bin fell over.

Gary Rostron, 34, had been accused by council chiefs of "incorrectly placing his rubbish bags beside his collecting receptacle" and was ordered to pay a $120 fixed penalty notice, The Daily Mail reported Monday.

However, Rostron decided to fight the fine in court, saying his garbage was in the alleyway because his bin had been knocked over. The magistrates threw the case out.

"I had put the bags in the bin and left them out for the bin men," Rostron said. "They must have been knocked or pushed over after that. I tried to explain to the council thinking they would see reason but they didn't want to listen."

Rostron blasted council officials for wasting "thousands of pounds of taxpayers' money" on his case that "would be better spent on cleaning up the streets."

"I'm glad I fought it and the magistrates realized I was telling the truth," he said.
