Chicago sandwich name ordered stricken

CHICAGO, Aug. 31 (UPI) -- A Chicago restaurant owner is under legal pressure to change the name of a sandwich he says honors the venerated Marshall Field's department store.

Since opening in March, Brad Rubin, owner of Eleven City Diner, has had the "Marshall Field's Special" on his menu as a tribute to the sandwich served in the store's fabled Walnut Room for more than 60 years.

Beginning Sept. 9, Marshall Field's will be rebranded to Macy's, which is owned by Federated Department Stores.

Wednesday, Federated faxed Rubin a letter telling him to stop infringing on the Field's' trademark, the Chicago Sun-Times reported Thursday.

A Federated spokeswoman said the company sent the letter after getting a call about the sandwich.

Rubin told the newspaper he'll likely pull the sandwich and fork out thousands of dollars to reprint his menus and fliers, but said it was sad nonetheless.

"But at the end of the day, it's a sandwich," he said. "The loss of a sandwich is nothing in comparison to the loss of Marshall Field's."
