William, Kate weigh suit over topless pics

LONDON, Sept. 14 (UPI) -- British Prince William and Catherine, the duke and duchess of Cambridge, are considering legal action over topless photos of Catherine, a spokesman said.

The couple are angered that the French magazine, Closer, published the photos taken last month when the duke and duchess were vacationing in Provence, The Daily Telegraph reported Friday.

The photos represent "the worst excesses of the press and paparazzi during the life of Diana, Princess of Wales," a statement from St. James Palace said.

Aides to the royal couple said a "red line was crossed," and intimated the couple were considering suing the magazine and photographer for invasion of privacy.

The royal family traditionally doesn't take legal action against media, the Telegraph said.

"Their royal highnesses have been hugely saddened to learn that a French publication and a photographer have invaded their privacy in such a grotesque and totally unjustifiable manner," the statement said. "Their royal highnesses had every expectation of privacy in the remote house. It is unthinkable that anyone should take such photographs, let alone publish them."

"Officials acting on behalf of their royal highnesses are consulting with lawyers to consider what options may be available to the duke and duchess," the statement said.

Officials said the swimming pool where the couple were sunbathing was in plain sight of a public road.

"If two public figures chose to strip off in full view of a public road then they can expect to be pictured," a source at the magazine told the Telegraph, "and they were."


Dog act wins 'America's Got Talent'

NEW YORK, Sept. 14 (UPI) -- The Olate Dogs canine act has been declared the Season 7 winner of the NBC competition series "America's Got Talent."

The performing pups -- and father-son trainers Richard and Nicholas Olate -- won the top prize of $1 million. They will also headline a show in Las Vegas.

Comedian Tom Cotter took second place in Thursday night's finale, which featured guest appearances by Blue Man Group, Justin Bieber, Green Day, Ne-Yo, Joan Rivers, Flo Rida and One Republic.

The show's host is Nick Cannon, and its judges are Howard Stern, Sharon Osbourne and Howie Mandel.


Sally Struthers arrested in Maine

OGUNQUIT, Maine, Sept. 14 (UPI) -- Actress Sally Struthers has been released on $160 bail after she was arrested for suspicion of operating a car under the influence, police in Maine said.

Struthers, 65, is best known for her work on TV's "All in the Family" and "Gilmore Girls."

CNN reported Struthers was arrested early Wednesday in Ogunquit, Maine, on a criminal charge of operating under the influence.

She is to be arraigned Dec. 13.

People.com said Struthers is in Maine performing in a stage production of the musical "9 to 5."

"Sally is working and she is fine and she loves The Ogunquit Playhouse and her yearly time in Ogunquit. We deny these charges," her publicist said in a statement issued to People.com.


Obama to appear on 'Late Show'

NEW YORK, Sept. 14 (UPI) -- U.S. President Barack Obama has been booked to appear on "Late Show with David Letterman" in New York next week, CBS said.

The commander-in-chief, who is seeking re-election, will appear on Tuesday's edition of the late-night chat show.

This will be Obama's seventh visit to the program and his second since he was elected president in 2008. He last appeared on the broadcast Sept. 21, 2009.
