Fight looms over Kid Rock/Scott Stapp tape

ANN ARBOR, Mich., Feb. 28 (UPI) -- Ann Arbor, Mich., attorney Peter Falkenstein says he will "vigorously" fight Kid Rock's attempts to quash sales of a sex tape he made with Scott Stapp.

Kid Rock has filed suit in federal court in Detroit seeking to stop California-based Red Light District, an adult films distributor, from selling the tape of him and Stapp having sex with women on a tour bus shot in 1999.

The Kid Rock camp recently won the first round, getting a preliminary injunction against any sales of the tape until the case is decided.

"Red Light District has not yet presented its case," Falkenstein said in a news release. "We intend to fully contest this matter at the next hearing, and for as long as it takes to vindicate my client's First Amendment rights."

Falkenstein denied the tape was stolen and further contended participants knew they were being taped at the time placed "no restrictions as to how it might be used."

The next hearing in the case is scheduled for late March.
