Actor Tom Sizemore misses hearing

LOS ANGELES, July 12 (UPI) -- Actor Tom Sizemore failed to appear at his Los Angeles probation violation hearing Tuesday because he reportedly had checked into drug rehab.

Los Angeles Superior Court Judge T.K. Herman signed a warrant for the "Saving Private Ryan" and "Blackhawk Down" star, but delayed issuing it, giving Sizemore until July 22 to return to court, the Los Angeles Times reported.

Defense attorney Michael J. Rovell said the 43-year-old Sizemore "is trying to get back his health."

But prosecutors said they would treat Sizemore's absence from court as a second parole violation. He could wind up in state prison if he chalks up three violations, the Times said.

Sizemore was supposed to be in court to answer to charges he used a fake penis to falsify a drug test.

Sizemore pleaded guilty in October to possessing methamphetamine, a felony.
