Judge reverses earlier Eminem call

NEW YORK, Dec. 23 (UPI) -- A New York judge will allow the release of a CD allegedly containing racist lyrics by white hip-hop artist Eminem, Billboard reported Tuesday.

A federal judge said that The Source, a leading hip-hop publication, can publish up to 20 seconds of previously unreleased Eminem music, with lines such as "black girls are dumb." The recordings will be enclosed in the magazine's February issue, due on the stand Jan. 12.

Last week, the same judge asked for an injunction, barring the publication of the music, as requested by Eminem's lawyers, who filed for copyright infringement.

In making the new ruling, the judge said limited reproduction of the recording falls within the magazine's right to "fair use" of copyrighted material for the purpose of criticism.

The music in question includes the lyrics "Black girls are dumb, and white girls are good chicks."

Reportedly, three white former friends of Eminem provided the recording to the magazine. Eminem said the recording was "foolishness" that he made as a teenager "out of anger, stupidity and frustration" after breaking up with a black girlfriend.
