Oklahoma's Supreme Court has agreed to hear arguments regarding a 3-year-old Cherokee girl who was separated from her adoptive parents. In the mean time, the court has granted an emergency stay to keep Baby Veronica with her biological father, Dusten Brown.
Brown has been fighting Baby Veronica's adoptive parents Matt and Melanie Capobianco for custody ever since he learned that his 3/256th Cherokee daughter had been adopted. He claims that the girl belongs with him under the rules set by the Indian Child Welfare Act.
In June, South Carolina's Supreme Court ruled that Brown should return Baby Veronica to her adoptive parents. After he failed to do so by August, he was arrested in his home state of Oklahoma, where he posted a $10,000 bond and left.
Now, Oklahoma's Supreme Court has agreed to take on Brown's appeal over custody of the toddler.
Both Brown and the Capobiancos were in a Nowata County court Friday, but neither is allowed to comment on the case given that there is a gag order in place.
