NEW DELHI, Jan. 29 (UPI) -- India's Supreme Court dismissed a change of venue request Tuesday for the trial of five men accused in the December gang rape and death of a New Delhi woman.
Chief Justice Altamas Kabir dismissed the transfer petition because of a dispute concerning legal representation for one of the defendants, The Times of India reported.
The defendant on whose behalf the transfer petition was filed said he did not want to be represented by the lawyer who filed it.
The petition sought a trial location anywhere but New Delhi saying a fair trial could not be assured in the city where the incident took place, the Indo-Asian News Service IANS reported.
The victim, a 23-year-old physiotherapy student, died of injuries she suffered from a gang rape and beating that took place on a bus she and a male friend boarded.
The trial of the five is being conducted by a special fast-track court.
A juvenile justice board ruled a sixth defendant was a juvenile at the time of the attack and will not face trial before the special court, the Los Angeles Times reported Monday.
