Record settlement struck for shaken baby

VICTORIA, British Columbia, Aug. 9 (UPI) -- A British Columbia girl who sustained brain injuries by being shaken as an infant will receive a provincial settlement record of $13 million, judges ruled.

British Columbia Supreme Court Justice Malcolm Macaulay Tuesday approved the settlement arrangement first struck in January in Victoria, The (Vancouver) Province reported.

The decision eliminated a lengthy Supreme Court trial and sees the provincial government paying the bulk of the award for a girl identified only as E.B., the report said.

The child was an infant in foster care in 2008 by a registered foster mother in the municipality of Saanich. The woman's boyfriend, who was not registered, allegedly shook the child and caused severe brain injuries, the Canadian Broadcasting Corp. said.

The man was later found "not criminally responsible" for the incident. Under the settlement, he isn't required to pay anything, although the foster mother's insurance company agreed to pay $1 million.

The girl is now living with her biological grandfather, the CBC said.
