Judge declares mistrial in Kellen Winslow II rape trial; guilty on 3 counts

June 11 (UPI) -- A California judge declared a mistrial on eight charges Tuesday, one day after a jury found former NFL player Kellen Winslow II guilty of rape, indecent exposure and misdemeanor lewd conduct charges for inappropriate behavior with three women.

San Diego County Superior Judge Blaine Bowman said the same jury who found Winslow guilty on the three counts was "hopelessly deadlocked" on eight other counts. Collectively, Winslow was on trial for 12 counts involving allegations made by five women. The jury acquitted him on one count of lewd act in public.

The judge said the county will retry Winslow on the eight counts in which he declared a mistrial.

On Monday, the jury found Winslow guilty of raping a 59-year-old homeless woman in May 2018; exposing himself to a 59-year-old woman, a neighbor, that same month; and fondling himself in front of a 78-year-old woman in February.

The remaining charges include forcible sodomy involving the first 58-year-old woman; elder abuse and elder battery involving the 78-year-old woman; kidnapping for rape, forcible rape and forced oral copulation for an alleged attack on a 55-year-old woman in March 2018; and forcible rape and rape of an unconscious person in an alleged rape of a 17-year-old in 2003.

Police arrested Winslow in June 2018 on suspicion of kidnapping and raping the 55-year-old woman, a hitchhiker, and the two separate 2018 indecent exposure charges.

Wilson was then charged in July of that year for the rape of the 17-year-old after a judge ruled there was sufficient evidence to move forward with the case.

The former first-round draft pick of the Cleveland Browns played 10 years in the NFL before being suspended in 2013 for violating the league's performance-enhancing drug policy.

He also played for the New York Jets, the New England Patriots and the Tampa Bay Buccaneers.
