May 27 (UPI) -- Deputies arrested an off-duty police officer in Texas for fatally shooting his brother, who was a sheriff's deputy.

Stagecoach police officer Robert Lee, a 35-year law enforcement veteran, called police Saturday to report he shot a person trying to break into his home in Stagecoach Farms, Texas, located about 40 miles northwest of Houston.

When the Montgomery County Sheriff's Office arrived on the scene, they found Robert Lee's brother, 57-year-old Rocky Lee of the Harris County Sheriff's Office, shot to death in the master bathroom.

In a statement, the MCSD said they didn't believe there was a break-in and that Rocky Lee was at the residence to check on his brother's welfare.

Officials arrested Robert Lee, 59, and charged him with murder. His bail was set at $500,000.

"The exact circumstances surrounding the shooting are under investigation," Montgomery County Sheriff's Office spokesman Scott Spencer told the Houston Chronicle.

The case is being investigated by the MCSD, the Montgomery County District Attorney's Office and the Texas Rangers.
